FISHBUOYTM Privacy Policy


FISHBUOYTM Online and FISHBUOYTM App, [FISHBUOY Software], offers fishermen the ability to view, post and share fish and landscape photos and associated water data, weather data, and fishing catch data on a map, to help fishermen identify when and where to fish.  Any registered user of FISHBUOY Software may share their own photos or photos posted in FISHBUOY Groups via email, text/sms, Twitter, Facebook, Pinterest, Instagram, etc.

Hint: What you post publicly on FISHBUOY Software may be viewed all around the world by other registered FISHBUOY Software users.  

Tip: When you take a photo, you should consider the private and public switch feature.  When you share photos to FISHBUOY Groups, you should remind your FISHBUOY Group members to hold all group photos as private, unless otherwise stated.  

This Privacy Policy (“Policy”) describes how and when FISHBUOY Software and websites collect, use and share your information when you use FISHBUOY Software or its websites. FISHBUOY Software receives your information through our website, FISHBUOY App’s and associated FISHBUOY Software API’s, email notifications, applications, buttons, our partners and other third parties. An example of this includes sending us information when you use FISHBUOY Online, or from FISHBUOY App. When using any of our FISHBUOY Software you consent to the collection, transfer, storage, disclosure, and use of your information as described in this Privacy Policy.

If you live in Canada or the United States, your information is controlled by ENVionX Inc., 295 Hagey Boulevard, 1st Floor, West Entrance, Waterloo, Ontario, Canada, N2L 6R5.  Despite this, you alone control and are responsible for the posting of your fishing photos publicly and other content you submit through FISHBUOY Software and websites, as provided in the Terms of Use Agreement.

Irrespective of which country you live in, you authorize us to use your information in, and as a result to transfer it to and store it in, Canada, the United States and any other country where we operate. Privacy and data protection laws in some of these countries may vary from the laws in the country where you live.

Hint: We collect and use your information below to access and use the features of FISHBUOY Software and to measure and improve it over time.

User Account Information: When you create a FISHBUOY Software user account, you provide required and/or optional personal information including your name, username, password, email, address, phone number, profile picture and fishing interests.  You may either use your real name or a pseudonym.  This account information is used to verify your information related to the FISHBUOY Software used or subscribed to.

Contact Information: We may use your contact information, such as your user name, name, email address or phone number, to customize your account or enable FISHBUOY Software, for example, for login verification.  We may use your contact information to send you information about our FISHBUOY Software, to market to you, to help prevent spam, abuse, or fraud, and to help others find your account, including through third-party services and client applications. You may use your settings for email and mobile notifications to control notifications you receive from the FISHBUOY Software. You may also unsubscribe from a notification by following the instructions contained within the notification.

Additional Information: You may provide us with profile information including your major species category of fish, individual species of fish, preferred body of water type, preferred fishing technique, and your preferred unit measurements.  Providing the additional information described in this section is entirely optional.  Additional information is used to provide FISHBUOY users with information relevant to user preferences, and to help third-party services send you relevant information.

Fish Catch and Landscape Photos: When you take a photo with FISHBUOY App or upload historical photos containing EXIF data, FISHBUOY Software will post the photos on a map publicly or privately, depending on the options selected during taking the photo, or during photo uploading.  FISHBUOY Software publishes/plots fish and landscape photos on FISHBUOY Software maps, solely to help fishermen, regulatory fisheries agencies, not-for-profit fishing organizations, and other third-party services identify trends in fishing success both spatially and temporally.  This may be used for improving individual fishermen planning/success, to support improvements to fisheries, or to market to, using geo-location specific information relevant to the fishermen.  It is recognized that fishermen often take fishing pictures that include themselves, fishing buddies, or other people, intentionally or unintentionally, in their fish or landscape photos.  It is the users responsibility to identify what is in the photo, prior to taking the photo, to ensure photos posted publicly to the FISHBUOY Community is acceptable for public posting.  FISHBUOY users are not required to post any photos publicly and have the option to select “private” prior to taking a photo or when uploading using FISHBUOY Software.  

TIP: It is encouraged that any photo posted publicly and deem offensive, inappropriate, abusive, sexually explicit, defamatory, infringes on copyrights, brands or other intellectual property rights, or otherwise is contrary to our Term of Use Agreement, should be immediately This email address is being protected from spambots. You need JavaScript enabled to view it. in order that we may remove the photos at our discretion.  After investigation, ENVionX Inc. has the rights to discontinue accounts related to posting of public photos that meet the aforementioned criteria.

Weather Information: When you take a photo, FISHBUOY Software automatically collects weather information relevant to your location, at the moment you take the photo.  This includes precipitation type, precipitation amount, cloud cover, air temperature (high/low), air pressure, wind direction and magnitude, moon phase and your location.  Weather information is provided to FISHBUOY Users to help them identify historical trends in weather that influence fish behavior. We may use this information to identify global trends in fishing behavior related to species type, geographic locations and may be provided to regulatory fisheries agencies, not-for-profit fishing organizations, and other third-party services identify trends in fishing success both spatially and temporally.  

Water Information: When you take a photo, FISHBUOY Software automatically collects water information relevant to your location, at the moment you take the photo.  This includes, and where applicable, water elevation, water discharge, water temperature, water turbidity and your location.  Water information is provided to FISHBUOY Users to help them identify historical trends in water conditions that influence fish behavior. We may use this information to identify global trends in fishing behavior related to species type, geographic locations and may be provided to regulatory fisheries agencies, not-for-profit fishing organizations, and other third-party services identify trends in fishing success both spatially and temporally.  

Location Information: FISHBUOY Software receives information about your geographic location and stores this information at the moment you take photos that are posted onto FISHBUOY Software maps privately or publicly. For example, you may take a fish photo in the field, and in order for FISHBUOY Software to obtain water and weather information relevant to your location, FISHBUOY App will search for your location using your device GPS.  We may use your photo locational information to identify global trends in fishing behavior related to species type, geographic locations and may be provided to regulatory fisheries agencies, not-for-profit fishing organizations, and other third-party services identify trends in fishing success both spatially and temporally.  

TIP: Users may choose not to allow GPS access, and may change their device GPS settings.  In this case, FISHBUOY Software will not be able to collect weather, water, and location information to improve user fishing success.

Links: FISHBUOY Software may keep track of how you interact with links across our FISHBUOY Software, websites, email notifications, third-party services, and client applications, by redirecting clicks or through other means. We do this to help improve our FISHBUOY Software and website user experience, to provide more relevant advertising, and to be able to create, view and share summarized click statistics.

Cookies: Like many websites, we use cookies and similar technologies to collect additional website and technology usage data and to improve FISHBUOY. A cookie is a small data file that is transferred to your computer or mobile device. FISHBUOY Software may use both session cookies and continuous cookies to understand how you interact with our FISHBUOY Software, to monitor usage by users and web traffic routing on our FISHBUOY Software and website, and to customize and improve our FISHBUOY Software. Although most web browsers automatically accept cookies, some browsers’ settings can be modified to decline cookies or alert you when a website is attempting to place a cookie on your computer.  

Data Logs: When you use our FISHBUOY Software, we may receive information (“Data Logs”) such as your IP address, browser type, operating system, the referring web page, pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We receive Data Logs when you interact with our FISHBUOY Software and website, for example, when you visit our website pages, sign into FISHBUOY Software, interact with our email notifications, or visit a third-party services. We may also receive Data Logs when you click on, view or interact with links on our FISHBUOY Software, including links to third-party applications when applicable.  FISHBUOY Software uses Data Logs to better understand interactions and improve the functionality and efficiency of FISHBUOY Software, and to help predict future needs such as predicting topics that may interest you relevant to your FISHBUOY Software user experience, and to customize ads relevant to your aggregated interests.

Commerce Services: You may provide your Payment Information including credit or debit card number, card expiration date, CVV code, and billing address (collectively, “Payment Information”), along with your address, to complete a commerce transaction through our FISHBUOY Software via PayPal, and other third-party payment gateway commerce vendors. FISHBUOY Software stores your subscription information including name, user name, email, address, renewal date, subscription period, FISHBUOY Software version and subscription level.  We do not store your Payment Information as we consider it private, however to facilitate future subscriptions and purchases, PayPal or other third-party ecommerce vendors may store this information. In this case, your agreement to store private information remains between you and the commerce vendor. We do collect and store Transaction Data created by your purchases (“Transaction Data”). Transaction Data may include the users name and the date, time, subscription type, add-ons and amount of the transaction.

Third-Parties and Affiliates: FISHBUOY Software uses a variety of third-party services to help provide our FISHBUOY Software features and functionality, such as accessing weather data and water data from government, private and not-for-profit organizations, and to help us understand and improve the use of our FISHBUOY Software and our websites, such as Google Analytics. These third-party service providers may collect information sent by your device as part of a web page request, such as cookies or your IP address. Third-party ad partners may share information with us, like a browser cookie ID, website URL visited, mobile device ID, to help us develop appropriate ads based on your user profile. For example, this helps us display ads where you have shown historical interest in, and relevant to fishing.

NOTE: Currently, FISHBUOY Software does not display ads but has the right to start, modify or deleted ads without notice.  If ads are engaged, and if you prefer, you will have the ability to turn off tailored ads in your privacy settings so that your account will not be matched to information shared by ad partners for custom and relevant ads.  Turning off ads only applies to paid subscriptions.  Trial software may be hardcoded to push ads.

Information Sharing and Disclosure


We do not disclose your private personal information except in the limited circumstances described here.

User Consent or Direction: We may share or disclose your information at your direction, such as when you authorize a third-party web client or application to access your account. Other users may share or disclose information about you, such as when they mention you, share a photo of you, or tag you in a photo when sharing via social media platforms. If you’ve shared information and photos via FISHBUOY Groups, emails, screen captures, Twitter shares, Facebook shares, Pinterest, texting, SMS, or other sharing methods. FISHBUOY Software cannot control how you, your FISHBUOY Group members, FISHBUOY Community, social media friends, family, will use, modify, post, share, your FISHBUOY Software photos that you have shared.  

Tip:  Keep in mind that photos posted publicly or shared via other means may become public, similar to when you share photos in social media platforms such as Twitter, Facebook, Pinterest, Instagram, LinkedIn, etc.

Service Providers: We engage service providers to perform functions and provide services to us in Canada and the United States, and other countries. We may share your private personal information with such service providers subject to obligations consistent with this Privacy Policy and any other appropriate confidentiality and security measures, and on the condition that the third parties use your private personal data only on our behalf and pursuant to our instructions. We share your Payment Information with payment services providers to process payments; prevent, detect and investigate fraud or other prohibited activities; facilitate dispute resolution such as chargebacks or refunds; and for other purposes associated with the acceptance of credit or debit cards.

Commerce Transactions: If you make a payment as part of a commerce transaction through FISHBUOY Software, your data will be collected via a commerce provider and include your name, user name, password, email address, shipping address, payment information and transaction data to facilitate payment processing, order fulfillment, and dispute resolution (including payment and shipping disputes) and to help prevent, detect, and investigate fraud or other prohibited activities. Please refer to these third parties’ privacy policies for information about their privacy practices.

Law and Harm: Notwithstanding anything to the contrary in this Policy, we may preserve or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation, legal process, or governmental request; to protect the safety of any person; to address fraud, security or technical issues; or to protect FISHBUOY Software rights or property. However, nothing in this Privacy Policy is intended to limit any legal defenses or objections that you may have to a third party’s, including a government’s, request to disclose your information.

Business Transfers and Affiliates: In the event that FISHBUOY Software via ENVionX Inc. is involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. This Privacy Policy will apply to your information as transferred to the new entity. We may also disclose information about you to our corporate affiliates in order to help provide, understand, and improve our FISHBUOY Software, websites, affiliated services and our affiliates’ services, including the delivery of ads.

Non-Private or Non-Personal Information: We may share or disclose your non-private, aggregated or otherwise non-personal information, such as your public user profile information, public photo posts, or the number of users who shared or clicked on a particular link or reports to advertisers about unique users who saw or clicked on their ads after we have removed any private personal information (such as your name or contact information).

Accessing and Modifying Your Personal Information


If you are a registered user of FISHBUOY Software, FISHBUOY website, or FISHBUOY email lists, we provide you with tools and account settings to access, correct, delete, or modify the personal information you provided to us and associated with your account. This is done when you login to your existing User Account of User Profile and update the data as per your needs. In some cases, your subscription may lapse, or you have not provide adequate payment details to continue your subscription.  In this case, FISHBUOY Software will deactivate your subscription and remove your ability to access FISHBUOY Software, however your Account Information will be remain dormant on FISHBUOY Software Servers up to a 12-month period after your renewal anniversary or after requesting cancellation of your subscription.  Your Account Information, User Profile, Photos and associated data will remain on our servers in the event you wish to reactivate your subscription. When your account is deactivated, it is not viewable on www.fishbuoy.com. For up to 12 months after deactivation it is still possible to restore your account if it was accidentally or wrongfully deactivated. You may also chose to delete, cancel or terminate your subscription to FISHBUOY Software.  In this case, you may send an This email address is being protected from spambots. You need JavaScript enabled to view it., Subject: Cancellation Request.  Keep in mind that search engines and other third parties may still retain copies of your public information, like your user profile information and public photos, even after you have deleted the information from FISHBUOY Software or deactivated your account.

Our Policy Towards Children


Our Services are not directed to persons under 18. If you become aware that your child has provided us with personal information without your consent, please contact us here. We do not knowingly collect personal information from children under 18. If we become aware that a child under 18 has provided us with personal information, we take steps to remove such information and terminate the child’s account. Changes to this Policy


We may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information and will always be at https://fishbuoy.com/privacypolicy. If we make a change to this policy that, in our sole discretion, is material, we will notify you via the email address associated with your account. By continuing to access or use the FISHBUOY Software after those changes become effective, you agree to be bound by the revised Privacy Policy.
